Terms of Service

Effective date: July 7, 2026

1. Agreement

By downloading, installing, or using the ZeroSpoils mobile application (the "App"), or by accessing zerospoils.com (the "Site"), you agree to these Terms of Service ("Terms") with 11895079 Canada Inc. ("ZeroSpoils", "we", "us", or "our"). If you do not agree, do not use the App or Site.

2. The service

ZeroSpoils is a food inventory and expiry-tracking app designed to help households reduce food waste. Features include:

  • Adding and managing food inventory with expiry dates
  • Expiry notifications and reminders
  • Shopping list management
  • Usage statistics and savings tracking

We reserve the right to add, modify, or remove features at any time. We will make reasonable efforts to notify users of significant changes.

3. Free and Pro tiers

ZeroSpoils is available as a free tier with core features, and a Pro tier with additional features available via in-app subscription. Subscription pricing, billing, and cancellation are managed through the Apple App Store or Google Play Store according to their respective terms. We do not directly handle payment card information.

Refund requests for subscriptions are handled by the relevant app store, not by ZeroSpoils directly.

4. Your account and data

ZeroSpoils is designed as an offline-first application. Food inventory and related data you enter is stored locally on your device. You are responsible for maintaining access to your device and any backups of your data.

You are responsible for ensuring that any data you enter is accurate. ZeroSpoils does not verify expiry dates or food safety information and is not a substitute for your own judgment regarding food safety.

5. Acceptable use

You agree not to:

  • Use the App or Site for any unlawful purpose
  • Attempt to reverse-engineer, decompile, or extract the App's source code
  • Interfere with or disrupt the App's servers, networks, or infrastructure
  • Use automated means to access or scrape content from the Site
  • Impersonate any person or entity

6. Intellectual property

All content, trademarks, logos, and software in the App and Site (including the ZeroSpoils name, Zesto mascot, and associated artwork) are owned by or licensed to 11895079 Canada Inc.. You may not reproduce, distribute, or create derivative works without our written permission.

7. Disclaimers

The App and Site are provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

ZeroSpoils does not guarantee that expiry reminders will be delivered at any specific time, or that the App will be available uninterrupted or error-free. Expiry reminders are a convenience feature only and are not a guarantee of food safety. Always use your own judgment before consuming food.

8. Limitation of liability

To the maximum extent permitted by applicable law, 11895079 Canada Inc. and its officers, employees, and affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the App or Site, including any loss of data, even if we have been advised of the possibility of such damages.

Our total liability to you for any claim arising from these Terms or your use of ZeroSpoils will not exceed the amount you paid us in the 12 months preceding the claim (or CAD $10, whichever is greater).

9. Termination

You may stop using ZeroSpoils at any time by uninstalling the App. We may suspend or terminate your access to the App if you breach these Terms. Active Pro subscriptions will continue until the end of the current billing period, after which no further charges will be made.

10. Governing law

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of law principles. Any dispute arising from these Terms will be subject to the exclusive jurisdiction of the courts located in Ontario, Canada.

11. Changes to these Terms

We may update these Terms from time to time. We will update the effective date above and, where practical, notify users of material changes via the App or email. Your continued use of ZeroSpoils after changes are posted constitutes your acceptance of the updated Terms.
